These terms and conditions of sale (hereinafter "T&Cs") apply to all sales of products made by the Abbaye de Morgeot wine estate, whether through the website www.abbayedemorgeot.fr, by correspondence, or during direct sales at the estate.
Article 1 — Purpose
These T&Cs govern the conditions of sale of the wines produced by the wine estate Abbaye de Morgeot — Domaine du Duc de Magenta, located in Chassagne-Montrachet (21190), France. They define the rights and obligations of the parties in the context of distance or direct sales of the estate's products.
Any order implies the buyer's unreserved acceptance of these T&Cs. The seller reserves the right to amend these T&Cs at any time. The applicable T&Cs are those in force on the date of the order.
Article 2 — Products
The products offered for sale are wines of controlled designation of origin (AOC) produced by the estate, including:
- Puligny-Montrachet Premier Cru "La Garenne"
- Puligny-Montrachet "Les Houillères"
- Chassagne-Montrachet Premier Cru "Abbaye de Morgeot"
- Bourgogne Blanc "Les Houillères"
- Bourgogne Rosé
- Bourgogne Rouge "Les Champans"
- Crémant de Bourgogne
- Mâcon-Villages
- Monthélie
The vintages offered may vary and depend on availability. Photographs and descriptions of the products are provided for guidance only. Despite all the care taken, minor variations may exist between the description and the product delivered (label, packaging). The estate undertakes to supply products that comply with the regulations in force in France.
Article 3 — Prices
Prices are stated in euros. For deliveries within mainland France, prices are quoted inclusive of all taxes (TTC), including VAT at the rate in force (20%). For export deliveries (outside France), prices are quoted exclusive of taxes (HT). Any customs duties and local taxes are at the buyer's expense.
Delivery charges are indicated separately before the order is confirmed. The estate reserves the right to change its prices at any time, products being invoiced on the basis of the prices in force at the time the order is confirmed.
Article 4 — Orders
The minimum order is 6 bottles (mixed selection allowed). Orders may be placed:

Any order constitutes acceptance of the prices and product descriptions. The estate confirms receipt of the order by email within 48 working hours. The sale is only definitively concluded after the seller has sent the order confirmation and the full price has been collected.
The estate reserves the right to refuse or cancel any order from a buyer with whom there is an unresolved dispute relating to the payment of a previous order.
Article 5 — Payment
Payment is made at the time of the order. The accepted means of payment are:
- Credit card (Visa, Mastercard, American Express) via our secure payment provider SumUp
- Bank transfer (bank details are provided upon order confirmation)
Card payments are secured by the SSL encryption protocol. The estate never has access to the buyer's bank details. In the case of payment by bank transfer, the order is processed upon actual receipt of funds.
Article 6 — Delivery
Deliveries are made by carriers specialised in wine transport:
- Mainland France: Colissimo — 2 to 5 working days
- European Union: DHL, Colissimo — 5 to 10 working days
- International: DHL, Hillebrand — 10 to 25 working days
Delivery times are given as a guide and do not constitute a contractual commitment. Any delay shall not give rise to any penalty, damages or cancellation of the order, except in the event of a delay of more than 30 days from the date of the order.
Delivery is made to the address provided by the buyer when placing the order. If no one is present, the carrier will leave a delivery notice. The buyer must check the condition of parcels on receipt and lodge any necessary reservations with the carrier in the event of apparent damage.
Important: During periods of high heat (June to September), the estate may postpone shipment in order to guarantee optimal transport conditions for the wines. The buyer will be informed by email.
Article 7 — Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the buyer has a period of 14 calendar days from receipt of the products to exercise their right of withdrawal, without having to give reasons or pay any penalty.
To exercise this right, the buyer must notify their decision by email to info@chateaudesully.com or by post to the estate's address.
Return conditions:
- Bottles must be returned in their original packaging, unopened, undamaged and in perfect condition
- Return shipping costs are borne by the buyer
- The buyer is responsible for adequately packaging the bottles for return transport
- Refunds are made within 14 days of receipt of the returned products, by the same means of payment as used for the order
The right of withdrawal cannot be exercised for opened, unsealed bottles or bottles showing obvious signs of use.
Article 8 — Warranties
The wines offered for sale are produced in accordance with French winegrowing standards and regulations. The estate guarantees that the products delivered conform to the description on the product sheet and the label.
The wines are packaged and shipped in suitable packaging (reinforced cartons, insulated where necessary) to ensure optimal transport and storage conditions.
In accordance with Articles L217-4 et seq. of the French Consumer Code, the buyer benefits from the legal warranty of conformity and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a proven non-conformity (corked wine, manifestly defective wine), the estate will replace or refund the product concerned.
Article 9 — Liability
The estate cannot be held liable for damage occurring during the transport of the products. In the event of a damaged parcel on receipt, the buyer must imperatively make written reservations with the carrier and inform the estate within 3 working days.
The estate cannot be held liable for non-performance of the contract in the event of force majeure, in particular bad weather, strikes, pandemic, raw material shortages or any other event beyond its control.
The estate's liability is limited to the amount of the order concerned. The estate cannot be held liable for indirect damages resulting from the purchase of the products.
Article 10 — Personal data protection
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of 6 January 1978 as amended, the personal data collected when placing an order (name, address, email, telephone) is necessary for the processing and delivery of the order.
This data is retained for a maximum period of 3 years from the last order, in accordance with legal and tax obligations. It is never passed on to third parties for commercial purposes.

Article 11 — Intellectual property
The trademarks "Duc de Magenta" and "Abbaye de Morgeot", as well as all the logos, coats of arms, visuals and content of the site, are the exclusive property of the Mac Mahon family and are protected by intellectual property law.
Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements is strictly prohibited without the prior written authorisation of the estate.
Article 12 — Prohibition of sale to minors
In accordance with the Évin Law (Law no. 91-32 of 10 January 1991) and Articles L3342-1 and L3353-3 of the French Public Health Code, the sale of alcohol is prohibited to minors under the age of 18.
By placing an order, the buyer certifies that they are of the legal age required to purchase and consume alcohol in their country of residence. The estate reserves the right to request proof of identity to verify the buyer's age.
Excessive drinking is harmful to your health. Please drink responsibly.
Article 13 — Governing law and jurisdiction
These T&Cs are governed by French law. In the event of a dispute relating to the interpretation or performance of these conditions, the parties shall endeavour to find an amicable solution.
Failing an amicable agreement, any dispute shall be submitted to the exclusive jurisdiction of the courts of Beaune (Côte-d'Or), notwithstanding plurality of defendants or third-party proceedings.
Article 14 — Mediation
In accordance with Article L612-1 of the French Consumer Code, in the event of an unresolved dispute, the consumer may have free recourse to a consumer mediator with a view to amicably settling the dispute.
